The presence’s declare is issued according to the the law no.68 (28 may 2007) concerning the “rules and regulations governing short stays of foreign nationals for reasons for visits, business, tourism and study” to foreign nationals who are entitled to stay in Italy for a period not exceeding three months or for the shorter period established in the entry visa for visits, business, tourism and study.
According to the law no.68, article 1, paragraph 2 (28 may 2007), on entering in Italy, the foreigner, coming from countries which didn’t sign the Schengen agreement, should present himself/herself with the presence’s declare to the mountain border posts, where the travel document will be stamped in corfomity with the Schengen agreement. On the other hand, the foreigner, who comes from a country which has signed the Schengen agreement, should present the presence’s declare (within eight days her/his entrance in
Italy) to the police commissioner of the “provincia” (provincial administration) in which she/he is, filling a specific form if she/he lives in one of the accomodations provided for the article 109, paragraph 1, of the decree 18 june 1931, no.773.
